    IDENTIFIABLE AND CONFIDENTIAL INFORMATION

    When a person or company becomes a Madison 1031 client, we recognize that our client will deposit sensitive business, financial and real estate documents with us, along with other information needed, to perform the 1031 Exchange.

    Madison 1031 receives two types of information from users of our service:

    1. "Personally Identifiable Information," defined as registration information (name and address), and financial information pertaining to the service, and communications between our client and others regarding the transactions.
    2. “Third-Party Identifiable Information,” including names and addresses of parties identified in the transaction, such as the buyer of the relinquished property, their lender, attorney and Realtor, and the seller of the replacement property, their lender, attorney and Realtor.

    Madison 1031 will not disclose a client’s Personally Identifiable Information or Third-Party Identifiable Information to a non-related Third Party except when we have the client’s express permission or under special circumstances set forth below.

    Personally Identifiable Information and Third-Party Identifiable Information may be disclosed under the following circumstances:

    • To send information to the client or a Related Third Party about or as part of the service when necessary;
    • When required by law enforcement authorities, upon receipt of appropriate documentation;
    • If necessary, in our good faith judgment, to protect our legal rights, or if the information relates to actual or threatened harmful conduct;
    • To third-party contractors (such as Madison 1031’s Internet Service Provider, search engine optimization vendor, PR firm, etc.) that assist us with our operations, provided, however, that our contractors use only such information as is necessary to perform specific tasks, and are required by agreement to maintain the confidentiality of any data they receive; or
    • If Madison 1031 or Madison Commercial Real Estate Services were acquired, the Personally Identifiable Information and Third-Party Identifiable Information of Madison 1031’s clients would be transferred to the acquiring entity. We may disclose aggregate data or analysis regarding the use of the Madison 1031’s web site and services to non-Related Third Party companies for marketing or other business purposes. All such aggregate data and the reports derived therefrom will not contain any Personally Identifiable Information or Third-Party Identifiable Information.

    All scanning, copying and sending of data will be handled by Madison 1031 employees who are bound by non-disclosure agreements.

    Madison 1031 and its parent company, Madison Commercial Real Estate Services, maintain user information for system administration and billing purposes. If a client cancels a transaction or closes an account, that client’s user information will be kept on file as long as is necessary for legal and financial auditing purposes.

    CHANGES TO THE PRIVACY POLICY

    If we plan to make significant changes to this Privacy Policy, we will post those changes to the Privacy Policy page before they take effect.

    ACCURATE AND UPDATED INFORMATION

    Madison 1031 maintains certain procedures designed to keep information accurate, current and complete. A Madison 1031 client has the option to change or modify information previously provided to the company by either visiting the Madison 1031 web site and accessing the client’s account information, or by contacting Madison 1031 at [email protected].

    LINKED SITES

    Madison 1031’s website contains links to other web sites. The sites listed as links are not under Madison 1031’s control. Madison 1031 is not responsible for the accuracy or reliability of any information that is accessed on any other Internet site(s) from the Madison 1031 website. Madison 1031 does not make any representations whatsoever concerning the content of those sites. The fact that Madison 1031 has provided a link to a site is NOT an endorsement, authorization, sponsorship, or affiliation by Madison 1031 with respect to such site, its owners, or its providers. Madison 1031 provides links only as a convenience to site users. We have not tested any information, software, products or services found on said sites and make no representations whatsoever with respect thereto.     INFORMATION SECURITY

    Madison 1031 works to protect Personally Identifiable Information and Third-Party Identifiable Information stored on the Madison 1031 servers from unauthorized access using commercially available computer security products, such as SSL and firewalls, as well as security procedures and practices. All employees must review and understand these practices, which include limiting access to sensitive information only to those employees who require the information and enforcing strict password protocols for all employees.

    Any information sent to a client by Madison 1031 may be sent via e-mail in clear text or can be accessed online. If a client chooses to receive these documents via email, please be advised that these documents are not encrypted and may contain sensitive business information. Madison 1031 and its parent company, Madison Commercial Real Estate Services, are not responsible for any unauthorized access to information contained in such reports sent via e-mail. If a Madison 1031 client wishes to receive encrypted documents, the client should contact Madison 1031 at [email protected].

    A log in and password are required for a client to gain access to the Madison 1031 online portal and to that client’s transaction information. Clients should protect the security of their passwords and log-in information. Madison 1031 and its parent company, Madison Commercial Real Estate Services, cannot be responsible for any unauthorized access to, disclosure or loss of any information in the event of a failure to protect password information.

    TRACKING UTILITIES AND SECURITY

    Madison 1031 designed features on its website to allow users to anonymously learn about the company’s services without revealing their identities. The only information we collect online is from cookies, pixel tags or similar devices, which provide limited data, such as the date, time and areas of our site that were visited, interactions on the site, and the Web path/domain from where the visitor came. Madison 1031 uses this information only to recognize the user as a unique visitor and hold information during the visit to the site. Tracking utilities identified here are not tied to personally identifiable information.

    This general information allows Madison 1031 to serve visitors better by continually improving its Web site and making it more convenient. In certain cases, users can choose not to provide us with the information by setting the browser to refuse to accept cookies, but if so, that may disable access to certain portions of the site.
